Out of court settlement agreed in injunction on NDC presidential primaries

The National Democratic Congress (NDC) has agreed with two of its disgruntled members to settle a case the latter brought against the party late last year.

Abdallah Issah and James Kafu Nartey-Oman secured an injunction on the NDC Presidential primaries on December 18, 2018.

In their substantive case, they want the court to make a declaration to the effect that the published guidelines for the conduct of the presidential election by the NDC in 2019 was null and void, ultra vires according to the NDC constitution, 1992.

They also seek a declaration that the procedure adopted by the NDC via the National Executive Committee (NEC) in the preparation and presentation of the guidelines, together with the amendments without prior consultation of the National Council of Elders, are unlawful.

But in the recent development, both parties have told the court that they are already in talks to address the issues raised by plaintiffs.

The court presided over by Justice Georgina Mensah Datsa has accordingly ordered the two parties to file their terms of the settlement in three days.

Earlier demands by ‘disgruntled 8’

Eight of the presidential aspirants of the filed a petition with the Council of elders of the NDC seeking some similar demands early on.

However, only on, that is reduction of the monumental filing fees that was granted.

It remains unclear if any of those aspirants are linked to this suit.
