EXPLAINER: Why the US court has jurisdiction in Anas, Ken Agyapong case

Many are questioning how such a case is possible and what it could mean for similar cases that may arise in the future.
This question has been answered by the credible law platform dennislawnews.com which has elucidated how the US-based court claimed jurisdiction over a case involving two people who are not just Ghanaians but also reside in the country.
To begin with, Anas is an internationally acclaimed journalist with global recognition. In the case of Kennedy Agyapong, the former Member of Parliament for Assin Central and the first defendant in the defamation case, he owns properties and business interests within the court’s jurisdiction in the US.
Additionally, the defamatory statements that Anas was challenging in court were made between May and November 2018, during which the former lawmaker was within the jurisdiction.
Some of the comments were said to have been made by Ken Agyapong in his home in West Orange, New Jersey.
Court documents added that a series of defamatory statements were made against Anas during a show called The Daddy Fred Show hosted by US-based Ghanaian Frederick Asamoah in New Jersey, who is the second defendant in the suit.
The case filed in May 2022 by Anas at the Essex County Superior Court in New Jersey has witnessed a jury awarding Anas $18 million in damages in his defamation suit against Kennedy Agyapong.
