High Court Orders Bank of Ghana to Reinstate TI Microfinance Licence

An Accra High Court has ordered the Bank of Ghana (BoG) to reinstate the operating licence of TI Microfinance, bringing relief to the company and its customers after months of uncertainty following the revocation of its licence.

The ruling was delivered after TI Microfinance successfully challenged the central bank’s decision through a judicial review application. The court held that the Bank of Ghana acted unlawfully in revoking the company’s licence and therefore directed that it be restored.

According to the judgment, the revocation failed to meet the required legal and procedural standards governing regulatory actions. The court emphasised that while the Bank of Ghana has broad supervisory powers over financial institutions, such authority must be exercised in strict compliance with the law and principles of fairness.

The licence revocation had forced TI Microfinance to suspend operations, affecting thousands of customers who rely on the institution for savings, loans, and other financial services. Staff members were also impacted as the company struggled to operate without regulatory approval.

With the court’s decision, TI Microfinance is now expected to resume operations, subject to meeting any outstanding regulatory requirements. Industry observers say the ruling restores confidence among customers who were concerned about the safety of their funds during the period of suspension.

Legal analysts describe the judgment as significant for Ghana’s financial sector, noting that it reinforces the role of the courts in holding regulatory bodies accountable. Judicial review, they explain, serves as a safeguard against arbitrary or procedurally flawed decisions by public institutions.

TI Microfinance has maintained that it was compliant with regulatory obligations and that the revocation of its licence caused reputational damage and financial hardship. The court’s ruling is seen as a vindication of the company’s position and a critical step toward rebuilding trust with clients and stakeholders.

The Bank of Ghana, which oversees banks, microfinance institutions, and other financial entities, has not publicly commented on the ruling. However, the decision may influence how future regulatory actions are carried out, particularly regarding due process and engagement with affected institutions.

As TI Microfinance prepares to restart full operations, customers and industry players will be watching closely to see how the institution stabilises its services and strengthens compliance measures. The ruling also sends a broader message to the financial sector about the importance of balancing regulation with fairness and legality.
